In accordance with the South Carolina Code of Laws 59-112-20, York Technical College is required to determine residence classification of applicants at the time of admission. To qualify for in-state tuition, a legal resident of South Carolina must have maintained his/her domicile in the state for at least 12 months immediately preceding the first day of classes for the term for which resident classification is sought.
Based upon the information on the Application for Admission or other data you have submitted, your residency status is classified as out-of-state. If you wish to appeal this decision, complete the attached form and bring it with you to the Admissions Office in the Student Services Building.
For independent persons or the parent, spouse, or guardian of dependent persons, examples of intent to become a South Carolina resident may include the following, although any single document may not be conclusive:
1. Possession of a valid South Carolina driver’s license, or if a non-driver, a South Carolina identification card. Failure to obtain this within 45 days of establishment of the intent to become a South Carolina resident will delay the beginning date of residency eligibility.
2. Possession of a valid South Carolina vehicle registration card. Failure to obtain this within 90 days of the establishment of the intent to become a South Carolina resident will delay the beginning date of residency eligibility.
3. Possession of a valid South Carolina voter registration card.
4. Ownership of principle residence in South Carolina.
5. Paying South Carolina income taxes as a resident during the past tax year.
Eligibility for SC residency cannot occur until 12 months from the date intent is established.
Upon establishing intent to achieve residence status, students employed full-time, by a single employer in South Carolina may be eligible to pay in-state tuition during the 12 months required to establish residency in the State.
Applicants asserting that his/her domicile has been established in South Carolina have the burden of proof. The residency official will consider any and all evidence provided concerning claim of domicile, but will not necessarily regard any single item of evidence as conclusive evidence that domicile has been established.
The resident status of a dependent person is based on the resident status of the person who provides more than half of the dependent person’s support and claims the dependent person as a dependent for federal income tax purposes.
The absence of indicia in other states is required before students can be eligible for South Carolina residency. For example, students cannot claim South Carolina as their state of legal residence while holding a driver’s license from another state.
